These "Terms of Service" establish the terms and conditions governing the use of https://aiquillz.com/ (referred to as the "Site") and its various components, subdomains, content (except as specified below), features, functions, products, services (collectively known as the "Services"), media, applications, and solutions provided on or through the Site, as well as across different modes, mediums, platforms, or formats (referred to as the "Platform" or "AiQuillz Platform," encompassing both "AiQuillz.com" and "AiQuillz.studio").
These Terms of Service are applicable to all users of the Platform, including individuals who visit the Platform and those who access the Platform, create an account, and use the Services (referred to collectively as "you," "your," or "Users").
This Agreement, comprising these Terms of Service, the Privacy Policy, and any additional terms, rules, policies, or guidelines referenced in these Terms of Service or the Privacy Policy, whether presented on the Platform or communicated otherwise to you (including terms from third-party platforms facilitating Platform access or Service usage), establishes the legal relationship between you and AiQuillz. This Agreement governs your interaction with the Platform and your utilization of the Services provided therein. Your acceptance of the Platform Terms is essential for accessing the Platform and using the Services, forming a legally binding agreement between you and AiQuillz. We encourage you to read the Platform Terms in their entirety.
Updated versions of the Platform Terms may be available for reference periodically. By visiting the Platform, providing your Personal Information (as defined in the Privacy Policy), using the Services offered, or consenting when presented with the option, you unconditionally accept and adhere to the Platform Terms.
If you disagree with any of the terms or choose not to be bound by them, please refrain from using the Platform. In these Terms of Service, references to "AiQuillz," "we," "us," and "our" collectively refer to AiQuillz, a company incorporated in Thailand. "AiQuillz.com" and "AiQuillz.studio" are both integral parts of the same entity. Further details about AiQuillz can be found in the 'About AiQuillz' section of these Terms of Service.
1. About AiQuillz
AiQuillz, a company incorporated in Thailand, operates the AiQuillz Platform, which includes the websites "AiQuillz.com" and "AiQuillz.studio". Our aim is to provide engaging and innovative solutions to enhance learning, creativity, and interaction. Through our Platform, we offer a variety of services, content, applications, and tools designed to facilitate education, entertainment, and personal development.
We are committed to ensuring a safe, secure, and enriching experience for our users. Our team works diligently to maintain the quality and functionality of our offerings, and we continuously strive to improve and expand our services to meet the evolving needs of our users.
At AiQuillz, we value your privacy and are dedicated to safeguarding your personal information in accordance with our Privacy Policy. We encourage you to familiarize yourself with our Privacy Policy to understand how we collect, use, and protect the information you provide us.

2. Platform Services
AiQuillz is a Online Platform that offers a range of services that utilizes (AI) "Artificial Intelligence" to assist Users to generate tailored content ("Generated Content") based on User's own input ("User Content Inputs").
In the context of the Platform Terms, the term "Platform Services"/ "Services" encompasses all the services mentioned in this section, along with any other products or services provided by AiQuillz through the Platform or in connection with it.
3. Eligibility and Platform Access
The Platform is designed for Users who are 18 years old or above. If you are under 18, access and use of the Platform are not allowed. Users may also include commercial entities, firms, sole proprietorships, or professional associations.
While accessing the Platform without creating an account is possible, only Users with registered accounts can store User Content Inputs and Generated Content on the Platform. Additionally, registered Users can avail themselves of any extra features offered on the Platform.
4. Account Management
By creating an account on the Platform, you gain the privilege of saving User Content (as defined below) and Generated Content.
Safeguarding the confidentiality of your account and password is paramount. You acknowledge that your account is strictly personal and undertake not to share access with others. It is essential to exercise caution while accessing your account from shared or public devices to prevent unauthorized viewing or recording of your username, password, or personal information. As the account holder, you assume responsibility for all activities conducted under your account.
Maintaining the utmost security of your password is crucial. If you suspect that your password has been compromised or is subject to unauthorized use, promptly change it or notify us to take appropriate action. Ensuring the accuracy and completeness of the information provided during registration is your obligation. Any changes to the information should be promptly communicated to us.
Furthermore, accessing the Platform and utilizing its Services requires the use of a "Supported/Compatible Device." A Supported/Compatible Device refers to a personal computer, mobile phone, portable media player, or other electronic device that meets the stipulated system and compatibility requirements and is authorized for Platform operation. Please be aware that the list of Supported/Compatible Devices may evolve over time and could be contingent on the software or systems provided or maintained by device manufacturers or third-party entities. Consequently, devices classified as Supported/Compatible Devices at one point may cease to be so in the future. Therefore, ensure that your chosen device aligns with our system and software to seamlessly access the Platform and leverage the offered Services.
5. Platform Usage
Provided you comply with all other terms and conditions outlined in the Agreement, AiQuillz grants you a limited, personal, non-exclusive, revocable, non-transferable, and non-sub-licensable license to access and utilize the Services, as specified in these Terms or any other written agreements (including emails).
When using any Generated Content, you commit to employing the Services in adherence to the Usage Policies of Open AI, Stability.ai, Microsoft's Azure, Google Cloud Platform (GCP), which are incorporated herein by reference. Each entity shall exercise sole discretion in determining these policies.
6. Account Termination
You have the option to terminate your account by ceasing its usage. Should you wish to delete your account, you may do so at any time by either contacting us through your registered email at support@aiquillz.com or using the delete option available within your account on the Platform (if provided).
AiQuillz reserves the right to immediately terminate or suspend your account, without prior notice, at its sole discretion, for any reason, including but not limited to a breach of the Platform Terms.
In the event your account is deleted or terminated (regardless of the reason), you will lose access to your account on the Platform, and any deletion carried out will be irreversible. Please note that AiQuillz assumes no responsibility for the loss of your information due to deletion, and shall not be held liable to any party for the inability to access any User Content or Generated Content resulting from such deletion or termination.
7. Intellectual Property Ownership and License
Ownership of User Content: You retain sole ownership of any data, such as code, audio files, video files, and software (owned by or licensed to you), as well as any other material you upload, publish, or submit on the Platform, including User Input Content ("User Content"). AiQuillz does not claim any ownership over the User Content you make available on the Platform. You acknowledge that AiQuillz has no control over User Content and assumes no responsibility for it. By using the Platform, you release AiQuillz from any liability arising from User Content. Furthermore, you confirm that your User Content does not infringe upon the intellectual property rights of any other party, and you have the necessary licenses to include materials in your User Content. You are solely responsible for any claims related to your published User Content on the Platform.
License to Generated Content: Subject to compliance with the Platform Terms, AiQuillz and its licensors grant you a non-exclusive, worldwide license, with the right to sublicense, to use, copy, modify, sell, create derivative works based on, distribute, publicly display, and publicly perform the Generated Content for your legitimate business purposes.
You acknowledge that AiQuillz has no control over the Generated Content and assumes no responsibility for it. By using the Platform, you release AiQuillz from any liability arising from the use of Generated Content. You are solely responsible for any claims related to the display, publication, or use of the Generated Content.
License to AiQuillz: You grant AiQuillz a non-exclusive, transferable, and sub-licensable (solely as set forth herein), worldwide, royalty-free license to use, host, store, copy, communicate, distribute, publish, create derivative works based on, publicly display, and publicly perform User Content solely for reasonable purposes, including operating and providing the Services, fulfilling obligations under the Platform Terms and other agreements with you, improving the Platform and Services, aggregating User Content with other data, and complying with applicable laws.
8. Claims concerning the utilization of third-party intellectual property
At AiQuillz, we value both our own intellectual property rights and the rights of others. If you believe that your intellectual property rights, or those of someone you are aware of, have been infringed upon, please reach out to us at support@aiquillz.com with all the necessary details as outlined below.
If AiQuillz becomes aware of or has reason to believe that any content on the Platform violates either AiQuillz's intellectual property rights or the rights of other users, we reserve the right to take down such content.
10. Trademarks and Other Intellectual Property Rights
Any product or service bearing the AiQuillz name or logo is a representation of AiQuillz itself. Unless authorized as one of our licensees, the use of our name or logo by others for making, selling, or distributing products is strictly prohibited.
If you believe that your intellectual property rights (excluding copyrights) or those of any individual you are aware of have been infringed, please reach out to us at support@aiquillz.com. Provide a detailed description of the trademark or intellectual property in question, along with the location on the Platform where the alleged infringement has occurred. Kindly include your contact information, including address, telephone number, and email address, for further communication.
11. AiQuillz's Rights: Regarding the entire Platform, AiQuillz retains the following rights
(a) AiQuillz reserves the right to temporarily suspend, reject, or terminate your registration/account on the Platform to comply with legal and regulatory requirements.
(b) AiQuillz may remove you, your User Content, or Generated Content without prior notice if you violate any provisions of the Platform Terms.
(c) AiQuillz holds the discretion to modify, terminate, or decline to provide Services at any time, without any obligation to give notice.
(d) Notwithstanding anything contrary stated in the Platform Terms, AiQuillz can remove anyone from the Platform at any time and for any reason.
(e) AiQuillz reserves the right to access your account and/or User Content or Generated Content to address technical support requests, maintain the safety and security of the Platform, comply with legal requirements, and for other legitimate business purposes, as deemed necessary by AiQuillz.
(f) AiQuillz is not obligated to actively monitor all content on the Platform or review user conduct. However, in the event of any violation of the Platform Terms coming to AiQuillz's attention, it reserves the right to deny your access to the Platform, terminate accounts, or remove violating content without prior notice to you.
12. Platform Availability
There might be occasions when your access to the Platform could be temporarily suspended or restricted to accommodate repairs, maintenance, or the introduction of new features or services. We will make efforts to minimize the frequency and duration of such instances. Please note that AiQuillz will not be held liable for any potential losses incurred by you due to the unavailability of all or part of the Platform at any time or for any period of use. We will strive to keep any disruptions to a minimum and ensure a seamless experience whenever possible.
13: Pricing, Payments, and Refund
14. Communications
When you visit the Platform, we engage with you electronically. During the account creation process or when purchasing a subscription for the Services, you may need to provide a valid email ID, phone number, and certain other details. As part of our communication strategy, we may reach out to you via email, SMS, phone calls, or by posting notices on the Platform, or through other communication modes.
By providing your information, you authorize AiQuillz, its affiliates, and their respective employees, agents, and contractors to initiate electronic communications, such as email, telephone calls, or other modes, related to your Platform use and the products and services (including the Services), newsletters, marketing, and promotional materials offered by AiQuillz and/or its affiliates. These communications may be conducted by or on behalf of AiQuillz, even if your phone number is registered on any state or central do not call list. Please note that telephone calls may be recorded for quality and training purposes.
You acknowledge that your telephone operator and/or internet service provider may levy certain charges on you for your communications with AiQuillz, and you agree to be responsible for all such charges. AiQuillz will not bear responsibility for any such charges.
If you do not wish to receive communications by telephone, text, email, or other modes, please refrain from submitting your information or opt-out later by following the relevant instructions provided via text, email, or other communication methods in any promotional communication received. Moreover, you will have the option to unsubscribe or opt-out from any promotional communications sent by AiQuillz and/or its affiliates through the disabling options available within your account on the Platform.
Please take note of the following:
- Opting out of promotional communications will not prevent us from sending you transactional communications, such as service announcements, administrative and legal notices, and account-related information, as you cannot opt-out of these necessary communications.
- If we have already shared your information with a third party (as detailed in our Privacy Policy) before your preference change or information update, you may need to directly adjust your preferences with that third party.
15. Privacy Policy
At AiQuillz, we are committed to protecting your privacy and ensuring the security of your Personal Information. Our collection, processing, sharing, and storage of any Personal Information collected from you to enable the Services strictly adhere to our Privacy Policy. We encourage you to read our Privacy Policy carefully to understand the measures we take to safeguard your Personal Information.

16. Feedback
We value your feedback and welcome any suggestions, ideas, comments, or questions you may have regarding the Platform or our Services. If you choose to provide us with such feedback, you grant AiQuillz and its affiliates a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, transmit, and display the feedback in any form.
Please note that by sharing your feedback, you do not acquire any intellectual property rights in the Platform. However, your valuable input helps us improve and enhance the Platform to provide you with the best possible experience. We appreciate your engagement and look forward to receiving your feedback!
17. Prohibited Use
By accessing and using the Platform, you agree to use it solely for the intended purpose for which it is granted to you. Throughout your usage, you must adhere to all applicable laws and regulations.
Furthermore, you must refrain from engaging in any of the following acts, or aiding, encouraging, requesting, or permitting others to do so:
(17A) Use the Platform or Services for any illegal purpose or in violation of local, state, national, or international laws.
(17B) Interfere with security-related features of the Platform, including attempting to disable or circumvent access controls or using unauthorized account credentials.
(17C) Disrupt the operation of the Platform or Services, causing performance degradation or interfering with other Users' experience.
(17D) Employ any means of automated data collection or indexing without prior written consent, including data mining tools, robots, or scripts.
(17E) Engage in activities causing societal harm, such as misleading users about the origin of Generated Content or generating spam.
(17F) Collect or store Personal Information from other users without their express permission.
(17G) Attempt to reverse engineer or decompile any component or software used to provide Services.
(17H) Use any engine, software, or tool other than those provided by AiQuillz to access or download content from the Services.
(17I) Misuse the Services by uploading, transmitting, or distributing content that violates the law, infringes on others' rights, or contains harmful elements like viruses or deceptive information.
Please adhere to these guidelines to ensure a safe and respectful environment for all users.
18. Linked Websites
The Platform may include links to third-party websites, including social media platforms and other resources. These links are provided solely for convenience, and we do not endorse or take responsibility for the content, products, or services offered on or through those external websites. Any use of third-party websites is at your own risk, and you acknowledge your sole responsibility for any consequences that may arise from accessing or using such websites or resources.
19. Disclaimer
YOU AGREE THAT THE PLATFORM, CONTENT, AND ALL MATERIALS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS AND YOUR USE OF THE PLATFORM SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, AIQUILLZ, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM AND EXCLUDE ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE PLATFORM AND YOUR USE THEREOF. TO THE FULLEST EXTENT PERMITTED BY LAW, AIQUILLZ EXCLUDES ALL WARRANTIES, CONDITIONS, TERMS OR REPRESENTATIONS ABOUT THE ACCURACY, SECURITY, RELIABILITY, QUALITY, AVAILABILITY OR COMPLETENESS OF THE PLATFORM, USER CONTENT/GENERATED CONTENT ON THE PLATFORM, OR THE CONTENT OF ANY SITES SO LINKED AND ASSUMES NO LIABILITY OR RESPONSIBILITY FOR ANY (I) ERRORS, MISTAKES, OR INACCURACIES IN USER CONTENT/GENERATED CONTENT OR ANY CONTENT ON THE PLATFORM, (II) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE PLATFORM, (III) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (IV) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE PLATFORM, (V) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE PLATFORM BY ANY THIRD PARTY, AND/OR (VI) ANY ERRORS OR OMISSIONS IN USERS CONTENT/GENERATED CONTENT OR ANY OTHER CONTENT OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF USER CONTENT/GENERATED CONTENT OR ANY OTHER CONTENT THAT IS POSTED, EMAILED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE PLATFORM AS AIQUILLZ IS STRICTLY AN INTERMEDIARY AS UNDER THE "THAILAND-COMPUTER-CRIME-ACT, 2007". AIQUILLZ DOES NOT WARRANT, ENDORSE, GUARANTEE, OR ASSUME RESPONSIBILITY FOR USER CONTENT/GENERATED CONTENT OR THE PLATFORM ADVERTISED OR OFFERED BY A THIRD PARTY THROUGH THE PLATFORM OR ANY HYPERLINKED SERVICES OR FEATURED IN ANY BANNER OR OTHER ADVERTISING, AND AIQUILLZ WILL NOT BE A PARTY TO OR IN ANY WAY BE RESPONSIBLE FOR MONITORING ANY TRANSACTION BETWEEN YOU AND THIRD-PARTY PROVIDERS OF USER CONTENT OR SERVICES. AS WITH THE PURCHASE OF A SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE.
20. Indemnification and Release
In compliance with applicable laws, you hereby agree to safeguard, indemnify, and hold AiQuillz and its affiliates, as well as their officers, directors, employees, and agents, harmless from any and all claims, damages, obligations, losses, liabilities, costs, or debts, including attorney's fees, arising from: (i) your utilization of or interaction with the Services/Platform; (ii) your violation of any stipulations within the Platform Terms; (iii) any allegations related to your User Content/Generated Content; (iv) any actual or claimed infringement, misappropriation, or breach of AiQuillz's, its licensors', or any third party's intellectual property or proprietary rights; or (v) your breach of any applicable laws. This duty to defend and indemnify will persist beyond these Terms of Service and throughout your use of the AiQuillz Platform.
Furthermore, you hereby explicitly release AiQuillz, its affiliates, and all respective officers, directors, employees, and agents from any costs, damages, liabilities, or other outcomes arising from the actions or omissions of any third-party vendors or service providers. Specifically, you waive any claims or demands you might have against AiQuillz, its affiliates, and any of their respective officers, directors, employees, and agents under any legal provision, contract, or other circumstances related to this matter.
21. Applicable Laws and Jurisdiction
AiQuillz operates under the framework of applicable laws and regulations. By using the AiQuillz Platform, you acknowledge that any disputes or claims arising from your use of the Platform will be subject to the laws and regulations of the jurisdiction of Bangkok, Thailand, without regard to conflicts of laws principles. Furthermore, you consent to the exclusive jurisdiction and venue of the courts located in Bangkok, Thailand, for resolving any disputes or claims related to your use of the AiQuillz Platform.
Please note that your consent to jurisdiction and venue as stated above does not preclude AiQuillz from seeking injunctive relief in any jurisdiction for the purpose of protecting its intellectual property rights or enforcing these terms.
21. Legal Notifications
If you encounter any further conflicts or assertions stemming from your utilization of the AiQuillz Platform or the Services, please don't hesitate to contact us at support@aiquillz.com.
22. Modification, Alteration, or Termination
AiQuillz reserves the exclusive right to alter or amend the Agreement and its policies at its own discretion, with such modifications or revisions binding upon you. Should you continue using the Platform following any changes to the Agreement, it will be considered as your agreement and endorsement of these modifications. The Agreement does not grant any rights or advantages to third parties. It is recommended that you regularly visit our Platform to stay informed about recent updates and remain current with the latest revisions.
23. Force Majeure
AiQuillz will not be held accountable for the inability to fulfill or the postponement of its obligations if such failure or delay is predominantly attributed to circumstances significantly beyond its control. Such circumstances include, but are not restricted to, acts of nature, actions by public entities or governments in their sovereign or contractual capacity, war, terrorism, floods, fires, labor strikes, epidemics/pandemics, civil disturbances, power outages, and exceptionally severe weather conditions.
24. Miscellaneous
In the event that any portion of the Agreement is determined to be unlawful, invalid, or unenforceable, that specific part will be considered separable, and its removal will not impact the validity and enforceability of the remaining provisions. Any notifications necessary concerning the Platform must be provided in written form and sent to AiQuillz's registered office. We cannot guarantee continuous, uninterrupted, or completely secure access to the Platform, as its operation may be impacted by various factors beyond our control. Headings are provided for reference purposes only and do not define, restrict, interpret, or describe the scope or extent of the respective section. Our decision not to take action regarding any breach, whether by you or others, does not constitute a waiver of our right to take action in response to subsequent or similar breaches.
25. Refund Policy
Should you decide to cancel your Subscription Plan (as defined in our Terms of Service), you can initiate the process within a period of 3 days. To request a refund, please contact us at support@aiquillz.com and provide the reason for your cancellation.
For Subscription Plans that involve a Fee payment (as indicated on the Pricing Page), you are eligible for a full refund (subject to applicable taxes) of the Fee if your cancellation request is submitted within 3 days from the date of purchasing your Subscription Plan. Please note that any refund requests received after this 3-day period will not qualify for a refund of the Fee.
Before proceeding with the purchase of any of our Subscription Plans, we recommend that you carefully review our Terms of Service, the Refund Policy, and any other relevant documents available on the Platform.
Upon canceling your Subscription Plan within the 3-day window, certain features exclusive to Subscription users may be deactivated, while your account will remain active on the Platform.
